PLEASE READ CAREFULLY THIS GENERAL CONDITIONS OF USE

1. These General Conditions will clearly regulate the resulting relationship between Biobé© and the consumers and users (hereinafter called the “Users”) that are registered as users and/or acquire products through the official web site of our on-line store "http://www.biobe.es", (hereinafter called the “Store”).

2. OBLIGATIONS OF THE USER

Generally, the User shall use the Store, acquire the products, and use every one of the services of the Store in a diligent manner, according to the Law, moral, public order, and the provisions of these General Conditions of Use. Likewise, the User shall abstain from using them in a way that can damage or deteriorate their normal operation and enjoyment by the users, babies, parents or relatives, or that could damage or cause damages to the goods and rights Biobé©, Users, or in general to any third party.

3. PRODUCTS AND PRICES

3.1 Biobé© reserves itself the right to decide, from time to time, the products that will be offered to the Users through the Store. In particular, Biobé© could add new products, at any time to the ones offered or included in the Store, otherwise, such new Products will be ruled by the provisions of these General Conditions of Use. Likewise, Biobé© reserves the right to stop or facilitate the access at any time and without prior notice of any of the different types of Products that are offered in the Store.

3.2 The Products included in the Store will correspond, in the most reliable form allowed by the most recent technology displayed on the web to the products actually offered. The characteristics of the Products and their prices will appear in the Store. The prices indicated in the Store are in Euros and except as otherwise provided, they do not include taxes and shipping costs.

4. PROCEDURE AND FORM OF PAYMENT OF THE PRODUCTS

4.1 In a term of one business day, Biobé© will send an e-mail to the User, confirming the purchase. This e-mail will assign a reference code for the purchase and will detail the characteristics of the Product, its price, shipping costs and data of the different options to carry out the payment of the Biobé© products.

4.2 The User that acquires a product through the Store shall carry out the payment through the payment systems specifically detailed in the Store. Depending on the method of payment elected by the User, the final price of the order could increase. In this case, before carrying out your payment, the User shall be informed of the exact cost of using this payment system.

4.3 Biobé© will file the electronic files where the contract is executed, sending a copy to the User once the purchase is made. The contract will be in Spanish.

4.4 The confirmation of the order sent by Biobé© is not valid as an invoice, just as proof of purchase. Biobé© will send the corresponding Invoice along with the product,.

5. HOME DELIVERY

5.1 The Products bought through the Store will be sent to the delivery address that the User indicates once the payment is verified. The delivery period set forth by Biobé© is between 2 and 15 business days depending of the stock. Delivery will be carried out through a freight company. If for any reason the order cannot be fulfilled in this period of time, Biobé© shall notify this situation to the User, and the maximum delivery period is thirty (30) days, pursuant to the Law.

5.2 Biobé’s home delivery will be carried out with collaboration of logistics operators of solid reputation.

5.3 The User will be informed about the exact shipping cost in the purchase cart prior to the acceptance of the acquisition of the Product.

6. RETURN OF THE PRODUCT

6.1 The User has the right to return the product and will have to contact Biobé© through e-mail at the following address: biobe@biobe.es. The Client shall have to withdraw from the purchase in a term of seven (7) business days maximum, parting from the reception of the Product. This return will be carried out according to the instructions that Biobé© indicates to the User in response to its notification of the exercise of the right of return. The Product shall be sent with the original package and with a copy of the delivery note or the invoice where the articles to be returned will be indicated. The User shall pay all return fees except when the reason of the return is due to a manufacturing defect. In this case, the return fee is reimbursed in the payment Biobé© makes to the User.

Personalized models (including all their fixtures) could not be returned, unless the reason for the return is that the product has a fabrication defect.

6.2 The return includes the return of the amount that was paid. Therefore, the client shall indicate to Biobé© the number and holder of the credit card that was used to make the purchase and the one that Biobé© shall use to make the deposit. If the User prefers, Biobé© could carry out the deposit of the return by transference to the account indicated by the User. The term for this deposit will be the one established by the Law once Biobé© has verified the good condition of the returned product.

6.3 The returned Product will not be accepted if it is not in its original package. Returns will not be admitted when the product shows that it was used or is in poor conditions.

7. CUSTOMER SERVICE

For any event, claim, or exercise of rights, the User can send an e-mail to biobe@biobe.es., or through regular mail to the address indicated at the beginning of the General Conditions of Use. In addition, he can make contact with the team of Biobé© by calling the number (+34) 638 066 204 from 09:30 AM (Peninsular Spain time), from Monday to Friday. If you need it, we have Claim Sheets issued by the government of Catalonia which we will send by regular mail.

8. INTELLECTUAL AND INDUSTRIAL PROPERTY

8.1 The user acknowledges that all the items in the Store, and every one of the Products, the information and materials contained in them, brands, structure, selection, ordering, and presentation of the contents, and the computer software used in relation to them, are protected by intellectual and industrial property rights of Biobé© and the General Conditions of Use do not provide any other right regarding the intellectual and industrial property rights different to those specifically set forth in them.

8.2 If authorized by Biobé© or by third party holders of the corresponding rights, or unless that it is legally allowed, the User could not reproduce, transform, modify, disassemble, carry out reverse engineering, distribute, rent, lend, make available, or allow the access to the public through any modality of public communication of anyone of the items mentioned in the former paragraph. The User shall use the materials, elements and information he/she encounters during the utilization of the Store only for his/her own needs, and shall not carry out directly or indirectly any commercial exploitation of the materials, elements, and information obtained through them.

8.3 The User shall abstain from eluding or manipulating any technical device established by Biobé© in the Store.

9. DATA PROTECTION

9.1 Biobé guarantees you that all the data that you provide to us will be handled with maximum confidentiality and security to avoid any alteration or loss, and any non-authorized access by third parties. Pursuant to the Organic Law 15/1999, of December 13, for the Protection of Personal Data (LOPD in Spanish). We inform you that all personal data you have provided us, or the one that you provide us during our commercial relationship, will be included in a file where Biobé will be responsible for it, and that personal data will be handled with maximum confidentiality in order to process your requests, orders, and collection, and to refer through any means, either automated or not (mail, SMS, MMS, fax, Internet, telephone), information and sales of our products. Likewise, we inform you that we will automate a registry of any communication you have with us, in order to keep our commercial relationship. If you want to consult, rectify, or cancel your data, or you do not want to receive any advertisement from us, please let us know about that through a writing to Biobé, clearly indicating your name, last name, address and client number, along with a copy of you DNI or call to (+34) 973 32 02 87 or send an e-mail to bio@biobe.es. Likewise, unless you indicate otherwise, you will receive information and sales promotions of Biobé through any means.

9.2 Secure payment and data confidentiality. Espiacenter.com GUARANTEES THE TOTAL PROTECTION OF YOUR DATA. Biobé’s web guarantees total confidentiality of your data thanks to the most advanced encryption technology (SSL of 128 bits). When making an on-line order, your personal and banking data are protected through SSL protocols before data are sent through Internet, thus, it is impossible to subtract or intercept them. After the order is received and processed, your data will remain protected in our databank, and they are at your disposal to be able to consult, modify, or eliminate them if you wish, such as stipulated by the Law.

10. PASSWORDS

Biobé© will facilitate the use of personal passwords to the User that is registered as such in the web site. These passwords will serve as the access to the services provided through the web site. The User shall maintain under its sole responsibility the passwords in the most strict and absolute confidentiality, assuming, thus, the damages or consequences that result from the revelation of the secret. Due to security reasons, the User could modify the password of telematic access to the services linked to the web site in any moment. The User shall immediately notify to Biobé© about any unauthorized use of his password, as well as the access by unauthorized third parties.

11. COOKIES

11.1 Biobé© uses cookies in order to improve its services to facilitate web surfing, maintain security, verify the identity of the User, facilitate the access to the personal preferences, and follow up his use of the Store. The cookies are files installed in the computer hard drive or in the memory of the navigator in the folder pre-configured by the User’s computer’s operative system to identify the user.

11.2 If the User does not want that the cookie installed in his computer, he shall configure his surfing program by Internet so he will not receive them. Likewise, the User could destroy the cookies as he/she deems appropriate. In case that the User decides to deactivate the cookies, the quality and speed of the service could decrease, and he/she could lose the access to some of the services offered at the Store.

12. APPLICABLE LAW AND JURISDICTION

These General Conditions of Use are ruled by the Catalonian legislation, and, in its absence, by the Spanish legislation. In any controversy that arises due to the interpretation or execution that could arise in relation to the validity, interpretation, fulfillment or resolution of this agreement, the parties agree to be subject to the laws and civil courts in the city of Lleida and to accept any judgment that may be passed in case of legal dispute, resigning to the jurisdiction that could correspond to the User, provided that the applicable legislation allows that.
